Cristhian Bahena Rivera will bot be sentenced today on his conviction of murdering Brooklyn’s Mollie Tibbetts. And Xavior Harrellson’s disappearance is being called into play as part of the defense attorney’s request for a new trial.
Judge Joel Yates will consider a motion to compel prosecutors to release evidence the defense claims as withheld from Bahena Rivera’s trial and to set a re-trial.
A motion filed Tuesday also refers to 50-year-old James Manuel Lowe, who allegedly ran a trap house in New Sharon. Defense attorneys say they have learned that Lowe had dated Sarah Harrelson of Montezuma. She’s the mother of 11-year-old Xavior Harrelson, who has been missing since May 27.
